Port Everglades Terminal, LLC (PET) is issuing invitations to Tender (ITT) that supports the Port Everglades Regional POWER (Port Operations with Efficiency and Reliability) Project. Port Everglades Terminal, LLC (PET), as a subrecipient under the U.S. Department of Transportation Maritime Administration Port Infrastructure Development Program (PIDP) through Broward County-Port Everglades, hereby invites qualified suppliers, manufacturers, contractors, and service providers (Bidder) to submit proposals for the supply, delivery, commissioning, training, warranty support, and associated services for the equipment identified in this Invitation to Tender.

As a Subrecipient under the Port Everglades Regional POWER (Port Operations with Efficiency and Reliability) Project, Port Everglades Terminal, LLC (PET) is responsible for the implementation of Component 2 of the approved Port Infrastructure Development Program (PIDP) grant. Component 2 consists of strategic investments in cargo handling equipment, terminal infrastructure, maintenance facilities, and electrical improvements intended to enhance terminal capacity, support projected cargo volume growth, improve operational efficiency and strengthen supply chain resiliency. The approved Statement of Work for Component 2 includes the following principal elements:

• Seven (7) Tier 4 Final - Container Top Loaders, one equipped with an over-height spreader

• One (1) Tier 4 Final - Container Top Handler with limited capacity for empty containers

• One (1) Tier 4 Final - Forklift 12.5-ton capacity

• Twenty-Five (25) LPG Terminal Tractors

• Two (2) Hybrid RTGs, each with one (1) spare spreader

• Two (2) RTG runways, each approximately 1,600 feet in length (construction)

• Maintenance, Washdown, and Service Facility (construction)

• Electrical upgrades for hybrid RTGs and Maintenance Facility (construction)

This solicitation, the evaluation of proposals, any resulting award, and any contract issued pursuant to this Invitation to Tender (ITT) shall be governed by applicable federal, state, and local laws, regulations, and grant requirements. Because this procurement is funded in whole or in part through the U.S. Department of Transportation Maritime Administration (MARAD) Port Infrastructure Development Program (PIDP), the following requirements shall apply in descending order of precedence:

Applicable federal statutes, regulations, executive orders, and grant requirements, including but not limited to:

• 2 CFR Part 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards.

• Build America, Buy America Act (BABA), where applicable.

• Applicable U.S. Department of Transportation and Maritime Administration (MARAD) requirements.

• The terms and conditions of the PIDP award and associated subrecipient agreement.

• Applicable requirements of Broward County and Port Everglades, including those incorporated into the subrecipient agreement between Broward County and Port Everglades Terminal, LLC.

• Port Everglades Terminal, LLC procurement policies, Code of Conduct, sanctions compliance requirements, and other applicable internal policies referenced in this solicitation.

•Applicable laws of the State of Florida, to the extent such laws are not inconsistent with applicable federal requirements governing this procurement.

In the event of any conflict between federal requirements and state, local, or internal requirements, the applicable federal requirement shall control.

Obtaining Invitation to Tender (ITT) Documents

Qualified suppliers, manufacturers, contractors, and service providers interested in participating in one or more of the active Invitations to Tender (ITTs) are invited to register with Port Everglades Terminal, LLC (PET). To obtain the complete ITT package and associated Tender Documents for any active solicitation, interested parties shall download and complete the Prospective Bidder Registration Form using the link provided below and return the completed form to the PET-PIDP Procurement Department in accordance with the instructions contained therein.

Upon receipt and verification of the completed registration form, PET will provide the applicable ITT package(s) and add the registrant to the official Procurement Distribution List for the selected solicitation(s). Registered Bidders will receive all subsequent Tender Bulletins, Addenda, Clarifications, and procurement-related communications issued for the applicable ITT throughout the procurement process.

Registration does not obligate any party to submit a Proposal, nor does it constitute prequalification or create any obligation on the part of PET to award a contract.
